Labeling this a "statistical inevitability" obscures the issue. It seems clear from numerous demos posted to YouTube that some autopilot users are very comfortable taking their hands off the wheel. That's an outright violation of the TOS. Yet, lots of people do it. Some erroneously refer to it as "hands free" mode.[1] Some even observe the fact that they're not supposed to do it while doing it.[2]

The human factors here are tough. But safe design needs to account for human factors. The enthusiast community seems especially prone to over-trusting the autopilot, and that's something Tesla should be examining in their safeguards.
